We reserve the right to alter, suspend or discontinue any aspect of our web site or the content or services available through it, including your access to it. Unless explicitly stated, any new features including new content and/or the sale of new services shall be subject to these terms and conditions.

All prices stated on this website are subject to VAT. We reserve the right to alter prices at any time.

Marketing-r-us can not be held responsible for the success of any of its campaigns and services carried out on a clients behalf nor for any subsequent losses resulting from any services offered.

Terms of trading

Parties:
Client: (your name & address)
Marketing Agency: Marketing-r-us

Marketing-r-us agrees to act as the sole marketing agency for (your name)

(A) Media Advertising & Press Releases: Marketing-r-us will plan, negotiate and book all national or regional media space as required for (your name) and supply artwork materials to publications. If no current artwork exists, the agency will help to provide the material through a third party. Cost for this will be charged direct to the client at the reduced agency-buying price. All Press Releases will be written and distributed on behalf of the client by Marketing-r-us. Any mailing costs will be charged to the clients at cost.

(B) Data: Marketing-r-us will plan and acquire data required for marketing campaigns on behalf of the client. Data will be purchased through third parties at the reduced agency-buying price and will be fully owned by (your name). Marketing-r-us can not be held responsible for the quality of the data supplied by any third party. The agency agrees to store the clients database on a secure server. All data bought under the clients name will not be passed to any third party without prior agreement of the client. Whilst using the database Marketing-r-us will remove or add contents if and when so required whilst fulfilling telephone marketing campaigns on the clients behalf.

(C) E-mail Marketing: Marketing-r-us will plan and fulfil e-mail campaigns on behalf of the client (your name) using the client's data. At no time can Marketing-r-us be held responsible for unsolicited mail campaigns. The agency will remove any personal data from the clients mailing database under the 'good practise e-mail legislation' if so required by the mailed party. Any templates required for regular mailing will be bought through a third party. Cost for this will be charged to client at the reduced agency-buying price.

(D) Websites: Marketing-r-us will design, build and regularly update (your name) website. Complex designs or e-commerce sites may require frame sets from third party suppliers. These will be acquired at the reduced agency-buying price and will be fully owned by the client (your name). Copyright on creative work produced for the client by Marketing-r-us will be the property of the client assuming payments have been made in full and the contract in between Marketing-r-us and the client has been fulfilled. Marketing-r-us will also provide a web positioning service through a third party on behalf of the client. This service will be regularly monitored by the agency and is charged at the reduced agency cost direct to (your name).

(E) Brochures & Leaflets: Marketing-r-us will design or help to design brochure and leaflet material for the client. Printable artwork and print fulfilment will be bought through a third party. Cost for this will be charged to client at the reduced agency-buying price.

(F) Power Point Presentations: Marketing-r-us will provide slide show presentations in Power Point for (your name) to the clients specification. Copyright on creative work produced for the client by Marketing-r-us will be the property of the client assuming payments have been made in full and the contract in between Marketing-r-us and (your name) has been fulfilled.

(G) Sales Letters: Marketing-r-us will write sales letters on behalf of the client to the clients brief. Sales letters will be provided in Word and will be the property of the client assuming payments have been made in full and the contract in between Marketing-r-us and (your name) has been fulfilled.

(H) Telephone Marketing: Marketing-r-us will undertake telephone-marketing campaigns on the clients behalf. If using the client's database Marketing-r-us will remove or add contents if and when so required to help the campaign. All telephone costs will be charged at BT rate (itemised billing may be available).

(J) Marketing Strategies: Marketing-r-us will provide (your name) with a detailed marketing strategy proposal for the 12 months term of contract. This strategy may not be passed to any third party or be used to run equal campaigns without the consent of the agency.

Term: The contract length for any marketing support package is 12 months and Marketing-r-us will commence work with immediate effect after the first monthly instalment has been received. The client can terminate the relationship with a minimum three months notice prior to the end of term. Should this be the case the client should consider that the agency may be unable to cancel certain marketing activities such as scheduled advertisements (see paragraph headed "Media Space Cancellations").

Third Party Charges: Items and services provided by third party at a reduced agency rate, will be charged direct to the client (your name) and are payable to the providers terms and conditions of sale. In some cases it may be necessary that Marketing-r-us have to purchase third party services on the clients behalf. Payment for these purchases will be charged up front and is payable within 7 days.

TERMS OF PAYMENT: Marketing Packages: Marketing-r-us will invoice the client one calendar month in advance for each package. This invoice must be paid in full within 28 days. Web Design: Marketing-r-us will invoice the client after the completion of their website. . This invoice must be paid in full within 28 days.

Copyright: Copyright on creative work produced for the client by Marketing-r-us will be the property of the client assuming the term of contract has been fulfilled and the Agency's accounts have been settled in full. Advertising materials will also be the property of the client and will be returned to the client on request. Marketing-r-us reserve the right to publish creative work produced for clients in the Agency's own promotional literature or advertising.

Client's Authority: The client's oral or written approval of any material such as copy, layouts, scripts, films, media schedules and estimates, etc, will constitute the agency authority to make use of such material consistent with Marketing-r-us's appointment as the client's marketing agency.

Advertising Standards & Media Recognition: Marketing-r-us is bound by rulings of the Advertising Standards Authority, the British Code of Advertising Practice and other codes of advertising standards laid down voluntarily within the advertising industry to ensure that all advertising placed by it is legal, decent, honest and truthful. The client agrees to inform Marketing-r-us forthwith if any claim, information or trade description in any copy submitted to the client by Marketing-r-us for approval is false or misleading or otherwise infringes the said rulings and codes and the client agrees to indemnify Marketing-r-us fully against the consequences of any such infringement and/or of the client's failure to notify Marketing-r-us there of.

Media Space Cancellations: Marketing-r-us is bound by the terms and conditions of media recognition agreements and all codes of advertising practice and conditions laid down by the media owners and contractors and for that reason cancellations and amendments of bookings previously made and alterations to copy can only be executed within the conditions.
